TERMS OF SERVICE

 

1. General Information

These Terms of Service ("Terms") govern your use of the Glowlexia Kitchen online store located at www.glowlexiakitchen.com (the "Store") and any purchases made through the Store. By accessing our Store, you agree to be bound by these Terms.

2. Acceptance of Terms

By placing an order, you confirm that you are at least 18 years old (or have parental consent), provide accurate information, and agree to our Privacy, Shipping, and Refund Policies.

3. Products and Pricing

  • Information: We strive for accuracy, but cannot guarantee that your screen displays colors perfectly. Products are subject to availability.
  • Pricing: Prices are displayed in the currency of your region. They do not include local customs duties or taxes (see Section 6).
  • EU customers: Prices displayed to EU customers include all applicable taxes where required by law.

4. Orders and Payment

We reserve the right to refuse or cancel any order for reasons such as product unavailability, pricing errors, or suspected fraudulent activity. Payments are processed securely via Shopify Payments and other displayed methods.

5. Shipping and Delivery

  • Processing: 1–3 business days
  • Packaging: Products are shipped in secure, standard protective packaging in the manufacturer's original packaging
  • Origin: We work with international fulfillment centers to dispatch products worldwide
  • Estimated delivery times:
    • 🇨🇭 Switzerland: 10–15 business days
    • 🇪🇺 European Union: 10–20 business days
    • 🇺🇸 USA / 🇨🇦 Canada / 🇬🇧 UK / 🇦🇺 Australia / 🇳🇿 NZ: 10–15 business days
    • Other regions: 15–25 business days
  • Tracking: A tracking number is provided within 3 business days of shipment

EU customers: In accordance with EU consumer law, we are responsible for the delivery of goods until they are physically received by you. Risk passes to you upon delivery.

6. Customs, Duties, and Taxes

International orders may be subject to import duties or taxes imposed by your country. These charges are the sole responsibility of the customer. Refusal of delivery due to customs fees does not entitle the customer to a refund.

EU customers: For orders shipped within the EU, VAT may be included in the displayed price where applicable.

7. Right of Withdrawal & Returns

🇨🇭 Swiss Customers In accordance with CO Art. 40d, Swiss customers have a 14-day right of withdrawal from the date of receipt. Please contact us at hello@glowlexiakitchen.com to process this without returning the item.

🇪🇺 EU Customers In accordance with EU Directive 2011/83/EU, EU customers have the right to withdraw from their purchase within 14 days of receiving their order, without giving any reason.

To exercise this right:

  • Contact us at hello@glowlexiakitchen.com before the 14-day period expires
  • No physical return is required — we will process your refund without return for hygiene and environmental reasons
  • Refund will be issued within 14 days of receiving your withdrawal request, via your original payment method, at no cost to you

Damaged or Defective Items If an item arrives defective or incorrect, we provide a free replacement or full refund upon photo/video verification within 30 days of delivery.

Non-Delivery Protection

  • 🇨🇭 Switzerland / 🇺🇸 USA / 🇨🇦 Canada / 🇬🇧 UK / 🇦🇺 Australia / 🇳🇿 NZ: 45 days from shipping date
  • 🇪🇺 EU: 45 days from shipping date
  • Other regions: 60 days from shipping date

8. Legal Guarantee (EU Customers)

In accordance with EU Directive 2019/771, EU customers benefit from a 2-year legal guarantee on all products. If a product is defective or does not conform to the contract, you are entitled to repair, replacement, or refund. This guarantee is in addition to our commercial return policy.

9. Dispute Resolution (EU Customers)

In accordance with EU Regulation No. 524/2013, EU customers may use the Online Dispute Resolution (ODR) platform provided by the European Commission to resolve disputes: 🔗 https://ec.europa.eu/consumers/odr

We are not obligated to participate in alternative dispute resolution but will make every effort to resolve disputes amicably. Contact us first at hello@glowlexiakitchen.com.

10. Limitation of Liability

Glowlexia Kitchen is not liable for indirect damages or issues arising from carrier delays, customs processing, or lost/stolen packages after delivery confirmation.

⚠️ EU customers: This limitation does not affect your statutory rights under EU consumer law.

11. Intellectual Property

All content (text, images, logos) is the property of Glowlexia Kitchen. Unauthorized reproduction is prohibited.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Fribourg, Switzerland.

EU customers: This choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.
